1. Introduction
These Terms and Conditions (“Terms”) govern the use of the website and services provided by IICS-UK Ltd. By accessing our website, purchasing books, or booking a collection, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.
2. Our Services
IICS-UK Ltd provides:
- A book collection and valuation service, where customers pay for the collection and assessment of books; and
- A book retail service, selling second-hand books directly through our own website.
All transactions are conducted directly between the customer and IICS-UK Ltd.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use our services. By using our website, you represent that all information provided is accurate and complete.
4. Collection, Valuation, and Payment
4.1 Booking and Payment
- Customers must provide accurate details when booking a collection, including the type, quantity, and general condition of books.
- A collection fee is payable in full at the time of booking via our secure online payment system.
- The collection fee covers transportation, handling, and professional valuation of your books.
4.2 Independent Services
The collection and valuation service is entirely independent from any decision to purchase your books. Payment of a collection fee does not guarantee that we will make an offer to buy your books, nor does it oblige you to accept any offer we make.
4.3 Non-Refundable Fee
- The collection fee is non-refundable once the collection has taken place, regardless of whether:
- You accept or decline our valuation offer; or
- We decide not to make an offer to purchase your books.
- The collection and valuation service is deemed fully performed once the books have been collected, and no refund will be due.
4.4 Valuation and Purchase
- After inspection, we may make an offer to purchase some or all of your books.
- You are free to accept or decline our offer.
- If you accept, ownership of the accepted books transfers to IICS-UK Ltd once payment is made.
- If you decline, ownership remains with you. You may arrange collection of your books at your own expense within 14 days, after which we may recycle or donate them responsibly.
5. Purchases from IICS-UK Ltd (Book Sales)
- All books sold through our website are second-hand unless otherwise stated.
- We take reasonable care to describe items accurately, including title, author, edition, and condition, but minor imperfections may occur.
- Images are illustrative and may differ slightly from the actual item.
- A contract of sale is formed only when you receive written (email) confirmation of dispatch.
6. Cancellations and Refunds
6.1 Collection Service
- You may cancel a collection booking within 24 hours of payment for a full refund.
- After 24 hours, or once the collection has occurred, the collection fee is non-refundable, including where no valuation offer is made or you choose not to sell your books.
6.2 Book Purchases
- Customers purchasing books from our website have statutory rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- You may cancel within 14 days of receiving your order by notifying us in writing. Returned items must be in substantially the same condition as received.
- Refunds will be processed using the same payment method originally used, within 14 days of us receiving the returned goods.
6.3 Refund Limitations
- Refunds will not be issued for items damaged after delivery, altered by the customer, or returned outside the permitted period.
7. Prohibited Use
You must not use our website or services to:
- Engage in fraudulent, deceptive, or illegal activity;
- Offer stolen or counterfeit goods;
- Interfere with website functionality or data security;
- Harass, abuse, or defame staff or other users.
We may suspend or terminate services for any breach of this clause.
8. Delivery
- Orders are dispatched within the timeframe stated on the product page or confirmation email.
- Risk of loss or damage passes to you upon delivery.
- We are not responsible for courier delays but will assist in tracing delayed or missing parcels.
9. Data Protection and Privacy
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy, available on our website, explains how your personal data is collected, used, stored, and shared. By using our services, you consent to this processing for legitimate business purposes, including order fulfilment, fraud prevention, and compliance with legal obligations.
10. Fraud Prevention and Compliance
- Payments are processed securely using recognised online payment systems that meet industry security standards.
- We cooperate with payment service providers and authorities to prevent fraud, money laundering, and unauthorised transactions.
- We may suspend orders or withhold funds if fraudulent or suspicious activity is detected.
11. Intellectual Property
All website content, including text, images, graphics, software, and design, is owned or licensed by IICS-UK Ltd. You may not copy, reproduce, distribute, or use any material without our prior written consent.
12. Limitation of Liability
- To the fullest extent permitted by law, our total liability for any claim shall not exceed:
- The amount paid for the collection service; or
- The purchase price of the relevant book, whichever applies.
- We are not liable for indirect or consequential losses, including loss of profit, opportunity, goodwill, or data.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
13. Indemnity
You agree to indemnify and hold harmless IICS-UK Ltd, its directors, officers, and employees from any losses, costs, or claims arising from your breach of these Terms, misuse of our website or services, or violation of any applicable law or regulation.
14. Termination
We may suspend or terminate your access to our services if you breach these Terms, provide false information, or engage in fraudulent or unlawful conduct. Termination does not affect rights or obligations accrued before the termination date.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Amendments to These Terms
We may revise these Terms from time to time. Updated versions will be posted on our website and take effect immediately upon publication. Continued use of our services constitutes acceptance of the updated Terms.
